Noise study makes noise at QW city council

Sound levels exploded when Mayor John Williams lost his temper, verbally attacking a constituent in a loud voice and slammed his open palm on the table during a meeting called to discuss a study about noise emenating from CB Freezers.

The normally affable Williams became incensed after goading Cliff White, a neighbour who lives just east of the Hwy. 33 plant, into admitting that after three years of battling to have the excessive noise levels controlled by the city, he no longer believed the mayor and city hall.

"You don't trust us?" Williams said in a loud voice, and he threatened to end the meeting, attended by about 30 people last week at city hall.

White, saying he was a taxpayer who deserved better treatment, stormed out of the room.

It was an explosive conclusion to the hour-long meeting, which broke up a few minutes after White's departure, with the promise that neighbours and CB Freezer management would meet in a few weeks time to further discuss the findings of the $18,000 noise study.

The meeting was not publicized by the city. In fact, it was White that notified The Trentonian the meeting was taking place at city hall.

"We didn't invite the world,'' said Williams in another exchange with White.

Williams has admitted to becoming "frustrated" in his bid to appease neighbours angry over the noise from a cooling tower and reefers running in transports to keep meat frozen at CB Freezers, located in the old FBI plant just west of the city limits in Murray ward, while trying to placate company management which is in the throes of expansion and has about 140 employees.

Neighours have complained bitterly that the mayor and city hall are putting jobs ahead of the quality of life for area residents, some of whom have put blankets over their windows to try to deaden the sound.

And the eight-page noise study, completed by J.E. Coulter Associates Ltd. of Toronto, proved the neighbours right — the sound is at times 60-to-80 per cent over the acceptable level of noise.

Coulter likened the sound, when it is at its peak from reefers, the loading dock and the cooling tower, to that of a Hercules aircraft flying over your house. But while the airplane noise lasts for a short time, the CB Freezer clamour can last hours.

"It's not gutwrenching (noise)," Coulter told the roomful of neighours, plant management owner Dale Willard and others, "(but) we found more noise than there should be."

The study contained three recommendations to bring the noise under regulation levels established by the Ministry of the Environment, including installation of silencers on the cooling tower, changing the parked and loaded trucks to face north, and perhaps build a noise barrier seven metres high (22 feet) high along the front property line of the plant. The last recommendation, Coulter conceded, would have to be more fully investigated because it could cause traffic problems for trucks entering and leaving the property on Highway 33.

Willard, who has built the company from two employees to a $70-million operation buying and selling meat on a global scale, said he was willing to be a "good corporate neighbour" and would take measures to control the noise.

"I think maybe there are some things we can do," he said. "We are not here to piss people off."

But the neighbours wonder why, then, have their complaints fallen on deaf ears for so long -- three families have sold their homes and moved after having their peace of mind, to say nothing of sleep, disrupted for years.

It appears the Ministry of the Environment will be called in since the noise levels are higher than the ministry's guidelines.

Williams said he was determined to fix the problem to the satisfaction of neighbours and the company.

On Monday, city CAO Gary Dyke, said the next step is to put a plan together in order to implement recommendations in the study.

"The process has already started,'' said Dyke.

But it's not known how much the noise abatement measures will cost CB Freezers. There's also growing speculation the city may share in the cost.

Mayor John Williams could not be reached for comment.

Another beautiful evening, but I'm sure you're not putting up with the noise in the Oak Hills that we are putting up with on the Carrying Place Road. Two reefers running on high, sitting at the front of the factory making it impossible to enjoy the night.

When are we getting some results regarding the noise study?

As for the Ministry of the Environment and Lou Rinaldi, I have kept emails from both of you telling us that we do not have to put up with the noise and that no one can take away the enjoyment of our homes. Well, if you think any of us are enjoying this, think again. All Can is now running reefers and both of these factories are sitting in the middle of a residential area, regardless of how you have zoned it.

The XXXXX's, the XXXXX's and others to the east of us are complaining as well. How many home owners do you need to either move or put their homes up for sale. As a show of support I think all of us should put For Sale signs on our homes . It will bring the attention of the public to our situation. This has been going on for three years now and looking back on some of the correspondence I have had I actually have to laugh. The double talk and false promises are becoming too much.

Tonight, as my husband and I walked our dog we were absolutely stunned at the amount of noise coming from CB Freezers. The people that live along Mack Road are being subjected to an unbelievable amount of noise, making it nearly impossible to live there. The word is out and the sound study is in. Apparently CB Freezers is not making to much noise. This is from a counsellor who got the low down from the CAO. The Mayor being out of town, has not released the findings. Upon finding this out I had to make a call to the sound people. This, apparently is not the whole story. There were recommendations made and we are now left to wonder whether or not the whole story will come out when there is a meeting of the residents held. My only hope is that we now have the support of a few counsellors and we can get this looked after. Can anyone be trusted? Let's hope they step up to the plate and speak up and call it as they see it.

As our sound study is nearing completion I would like to make mention of noise that I have never heard before.

Apparently All Can has installed a compressor or something of the sort. There is the same type of noise, and I don't think it comes from reefers, coming from the south east corner of their building. There has never been that noise until the noise study began. I go to work at the same place for the last 25 years and I'm pretty sure I would have picked up on it by now. If this is an attempt to derail the noise study then I would say it probably will succeed.

We hear very little from City Hall or Lou Rinaldi regarding what is going on but they were front and center for their photo opportunity at the expansion announcement for CB Freezers. These are our tax dollars that are going to support this expansion and the promise of jobs just doesn't cut it for me. We also pay taxes and when it comes to big business they seem to forget that. They have managed to escape the union by not rebuilding in Wellington. Adecco is supplying the manpower and all that means is the employees will be making low wages and really not helping our community at all. They will be able to survive but that is about it. After all they should be thankful to have a job or so I've heard.

This is an election year and all I can say is to make your disappointment known with your vote.

Another night of reefer noise. I am not sure how the residents at the west end of the plant are making out but we have had a very loud reefer parked outside of our bedroom window that has been running since 5 p.m. Friday evening. I woke up several times during the night, hoping that someone would pick it up and drive away but no such luck.

I spoke with Paul and Nicki after they had moved to their new home and Capital Movers commented that they knew about the noise issue as they have already moved another person from the road due to noise. Is that what is going to happen now, people are just going to move in and move out as they realize how noisy this plant is allowed to be?

What are they doing on the old rail bed in behind our properties. Is this going to increase truck traffic are they putting a road back there? Why now after the birds have become to nest and is that area nto parkland? How does this affect Hannah Park? We used to walk on that rail bed as I am sure lots of people with children and dogs do.

We need some answers. Once again I am trying to go to my own business and I haven't slept for most of the night.

Although the residents on the Carrying Place Road have embraced the fact that the city was willing to do a noise study I am wondering how much noise we will begin to experience after the study has been done.

I believe that CB Freezers are doing things in order to mislead this investigation. For one thing, I have never heard continuous reefer noise coming from All Can directly across the road from Andjareenas Place, but in the last couple of weeks I have begun noticing a definate increase in noise. On Friday morning I left for work shortly after 5 a.m. and there were reefers running and the noise was definately coming from there. This week I also observed a reefer parked in the parking lot at the front of All Can parallel with hwy 33 and I haven't seen a reefer parked there in I don't know how long. Maybe years. The fact that these things are going on now that the noise study has begun makes me very concerned. Yes, we have our noise study but is it just smoke and mirrors?

I do not require an answer from you Mr. Mayor just keeping you up to date on what is going on.

I find it unconscionable that the City of Qunite West would allow any more reefers or "cold storage facilities" within their city limits. If ALLCAN is refrigerating cheese....it's only a matter of time before they will be refrigerating other products .......which equals REEFERS!!! And lots of them!

How is it ....I need a building permit to build a 10x12 shed or a 8x8 ft deck on my house, but these guys are allowed to build a "Cold Storage Facility" without approval by city council? Surely Gary Dyke must know something about this....he can't be that clueless or underhanded ......can he?

I too noticed the reefers at ALLCAN over the past couple of weeks. I guarantee CB Freezers are up to "no good". How do they go from having 8-9 reefers running all week/weekend to 1 or 2? CB has always done this. Anytime there is any sort of study or investigation....they go into "silent mode". They play dirty and always have. There is no way, we're going to get a fair and accurate measure of the intense noise emanating from CB unless it is a surprise or covert investigation. Why does The City of Quinte West always have this overwhelming urge to inform CB before they are being investigated? Could you imagine if the police or RCMP did this before investigating a criminal?

Yes. My husband was riding on the trail that leads behind AllCan last week and said that there were 5 reefers over there, three of them were running. I walk down that trail quite a bit and have never seen that before. I've seen trucks pull in, I've seen them parked there, but I've never seen them lined up and running. Sure enough, when I took a walk down there the other say I saw that there were several reefers lined up with at least one of them running.

Considering that the sound engineers have been taking ambient noise levels this week I find this very suspicious. If base readings were taken near the AllCan factory wouldn't this increase our ambient noise levels, making the noise contamination from CB Freezers seem less severe? I certainly hope that residents in whatever area they have done the ambient sound readings in have been canvassed to see if there has been any unusual activity.

I'm not sure what's going on , but on the eve of our noise study we now have new reefer noise. The All Can Warehouse across the road from Andjareenas Place has reefers running and they are loud. This hasn't occurred in years and it makes me wonder,(call me paranoid) why they are doing this now. Is it a show of force or solidarity?

This morning at 6:15 a.m. when I opened my kitchen windows I noticed that they have a reefer parked in the front parking lot, parallel with the highway. Again, it has been a very long time since they have done something like this.

Makes me wonder what's in it for them.

I am tired of spending my weekends angry as a result of the lack of consideration from CB Freezers. They load up on Friday night and turn their reefers on and away they go and the rest of us living in the area have to just put up with it. I like to think I am a professional person, after all we do have two businesses in town but I find myself becoming irrational when it comes to this plant. They had at least six reefers cycling on and off at the west end of the plant all weekend with two in front of the loading docks facing the highway and homes and two at the east end of the lot. They are loud and intrusive. Imagine the drone of a parked truck running outside your door nonstop. This truck does not pull away for 3 days. Working in your yard is not the enjoyable task it should be. Instead of opening our door and hearing the birds in the morning the first thing we hear is the trucks. I have lived in this house for 26 years and am depressed at the thought of perhaps having to sell but that is our plan. I emailed our Mayor on the weekend and he promptly returned the email stating that we had decided for the noise study to begin in May and did I want that changed. We are 10 days away and it is not for me to decide as I am only one voice. My biggest fear is that the noise study will not succeed in making life any more pleasant for us. I wonder how the Mayor will explain the number of moves from the Carrying Place Road to his constituents when he is running? It can't always be about business. We were here first and although our tax bill is not nearly as high as the one at CB Freezers, it is a tax bill we have paid for 26 years. Disappointment in our Mayor and council is an understatement but I must say be careful what you wish for Mr. Mayor. Although you have succeeded in possibly driving two of us from the neighbourhood and perhaps even one business you may have people that are more driven and more determined replace us.

It does not appear as though CB Freezers is making any attempts at mitigating the noise. Leaving refrigerated trailers to cycle on and off all weekend long, loading and moving trucks and trailers, disrupting the peace within our house, does not demonstrate any measure of respect for the residents who share this neighbourhood. Although we have been assured by the office of the Minister of the Environment that CB Freezers, and the City of Quinte West, are working to resolve the noise issue, our weekend was disrupted once again.

John Williams has decided to run for mayor of Quinte West once again. I understand that Mr. Williams campaign is based on attracting new employers to the Quinte West area. I wish Mr. Williams would place as much emphasis on the people who live here. Jobs are important, but what about the workers? I am a worker. My husband is a worker. What good are we when we are so tired, stressed and worn that we cannot function properly? I have asked Mayor Williams for help, I have begged, my health has been affected as a direct
result of the noise issue, yet the bombardment continues.

I sincerely hope that the sound assessment done in May will result in positive action for the other residents here. I hope that everyone keeps their word and that this issue will be resolved. For us, it's too little too late and although it may not be much, we're taking our tax dollars elsewhere.

Another weekend of noise and disruption thanks to the folks at CB Freezers/Chill Chain Logistics. Despite assurances from everyone from Mayor of Quinte West, John Williams, to the owner of CB Freezers, Scott Willard, reefers continue to be left running in the front loading area for hours on end. Again, our entire weekend has been disrupted by the droning noise of those monsters left in the front loading area of the building.

On Good Friday I was woken up at 7am to find that a street sweeper was cleaning the parking lot.

A reefer was left to run continuously in the front loading area of CB Freezers for approximately 18 hours.

Multiple reefers were left in the front loading area to cycle on and off, to disrupt our family dinners, to disturb our sleep for the entire weekend.

Our Easter weekend has been filled with noise and torment and it continues still.

This past Easter weekend CB Freezers/Chill Chain Logistics have demonstrated the level of their commitment to mitigating the noise from their facility by disrupting the entire Easter weekend. With total disregard for us, their neighbors, they left reefers running in the front loading area for the entire weekend. Despite the fact that I took prescription medication in order to deal with the noise, in order to sleep in my own home, I was still woken up repeatedly by the noise coming from Chill Chain Logistics reefers left to drone in the front loading area of CB Freezers.

Easter Weekend and thankfully we have been away, although before we left the noise was unreal. We have just arrived home at 2:00 a.m. on Sunday morning and all you can hear outside is CB Freezers.

My real fear is that if we have any change in government, both local and provincial, we will be starting all over again.

I'm sure they would embrace the change. It would allow them to continue to disrupt our lives.

Another week of noise. What I have difficulty understanding is why this bunch need to be loading in the middle of the night. Three nights this week I was awake at 2:30 in the morning. Not a nice way to live. I think I'll visit my doctor this week and see if I can get something to knock me out so that I can sleep in my own home. Isnt' that something? Like I'm not taking enough medication already.

Depression and desperation begin to become a regular way of life after awhile. I need to sleep for my health.

I happened upon an article in the EMC newspaper on Thursday March 25th regarding concerns over property owned by William Hitchon Pumps and Sprouts Landscaping. The neighbours are worried about expansion and about the size of the piles of soil and dust blowing into their homes. In the article "site plan control would look at fencing, berms and vegetation plantings", Pordham said. Terry Cassidy (councillor) suggested staff meet with the appricant and Ron Hamilton said withthe wind blowing here is a concern of dust flying into neighbours homes.

Are you kidding me? Dust? We, on the Carrying Place Road have been sucking up the dust from CB Freezers for 3 years now with the promise that they are going to pave. Not going to happen! We have not been able to sleep at night or open our windows due to he noise and in the article they mention a noise bylaw from 7 p.m.to 7 a.m. Are they not part of Quinte West or are the Sidney Township laws not the same as ours?

It has been extremely noisy of late. We have had to be up at 4:30 in the a.m. in order to pick up our son who was returning from Elliot Lake. The noise at that hour of the day was unbelievable. Our neighbours have sold their home unfortunately for the rest of us in the neighbourhood but we wish them well and understand that seven months of that was more than anyone else could endure. Reefers running at all hours, loading of trucks as well as the jet that seems to be taking off on a regular basis from the back of that building. I stepped outside at 7 a.m. to put my dog out and there was dead silence. I haven't heard that in a very long time. I'm hoping that I will be able to enjoy our yard this summer but I won't count on it. The wheels of justice turn slowly and sometimes simply grind to a halt.

I entertained the thought of holding outdoor events at my own business down the road but after being outside yesterday and hearing the drone of noise even that far away I can't see any of them being interested in coming as most of them are environmentalists and would simply not enjoy the experience. I do have to chuckle a bit when I read the City's website. There is nothing friendly about it and wouldn't encourage anyone to move here. Thank goodness I am a destination store and my customers come from out of town.

Sunday we went for a walk along the old railbed to get a birds eye view of what was making the noise. There is a large unit off the back of CB Freezers that cuts in and really does sound like a jet taking off. They have been relatively quiet of late, just a few occasional blips but true to form they couldn't keep it up. Last night it was noisy enough to wake me up and there was a certain vibration. Not sure what that was all about. I did hear the incoming aircraft but that is not unusual and not what normally wakes me up. I did manage to get back to sleep but when I put the dog out this morning the unit was running loudly. What I dont understand is why they were allowed to put that unit there in the first place. Pillsbury had a similiar unit but had to put it inside the building or deal with the neighbourhood! My fear is that when spring and summer arrive we won't be able to spend any quality time in our yard. Oh well we can put the hacienda up for sale. I wonder how city hall will feel as the for sale signs go up or if they just don't give a shit.

From Knickertwist...

An amazing little drama unfolded a few weeks ago and I stepped back from the upkeep of this blog. Truth be told I considered taking the whole thing down but someone came forward and said it should remain. Long story short, updates and information can now be sent to citizen@socialtech.ca who will anonymously post on behalf of affected residents.

Anyway, enough time has passed to warrant an update so here it is...

We have received a letter written on behalf of John Gerretsen, Minister of the Environment. The letter states:

"... ministry staff from the Peterborough District office have been communicating with you about Canadian Blast Freezers (CBF) and are actively working to ensure the City of Quinte West and CBF resolve this noise issue."

"I can assure you that the ministry will continue to work, along with the city, to ensure that CBF undertakes the appropriate actions to mitigate the noise from their facility."

Holy mother of Saltine crackers! It only took six months and about a zillion messages to be assured that action of some sort will be taken.

For those of you who attended the meeting at Quinte West city hall, the document that the acoustic engineer said applied to this particular case is NPC-205, Sound Level Limits for Stationary Sources in Class 1 & 2 Areas (Urban) Of particular interest in this document is that aircraft noise is excluded when measuring background noise levels. This may be something to bring up with the engineer when the assessment is done.

Another update comes from the Midtown Meats union web page:

"Although we had requested to be allowed to visit the Trenton facility to ensure the Midtown Meats Ltd. Collective Agreement is not being violated, Mr. Willard has denied the request."

Hmmm.

Last, but not least, despite the fact that the Ministry of the Environment has sent assurances that the noise issue will be dealt with, and the city has hired an acoustic engineer to assess the situation, we've had enough. This entire ordeal has left us tired, miserable and worn. And so, we're putting this joint up for sale and starting the search for a house that we can make a home.

Oh, in case you were wondering, we will be voluntarily disclosing the noise issue to potential buyers.

The Meeting

I'm so proud to live in this neighbourhood. Truly. The people here are fantastic and they care deeply about this place. There were about 20 residents who attended tonight's meeting. A couple said that the noise didn't bother them personally but that they were there to show their support for neighbours who were affected by the noise. Many were kind enough to share their own experiences.

One of the things that we were asked this evening was the times/days that the noise takes place. Here's the thing, there doesn't seem to be much rhyme or reason to when the noise occurs. Late at night, early evening, mid-morning, late afternoon... it's all over the place. What days? Again, there's no clear pattern that we can make out.

Today there was quite a bit of banging this morning, a bit of reefer noise, tomorrow there could be nothing at all, the next day reefers may run for hours on end. Some noise we don't hear at all but our neighbours will say they are disrupted. There are times we're faced with a great deal of noise that they can't hear. It really is difficult to pinpoint times and dates.

This blog expresses my personal experience with the noise bombardment from CB Freezers/Chill Chain Logistics. I don't expect it to make one bit of difference to the actual sound assessment. Residents know full well that CB Freezers/Chill Chain Logistics are the source of the noise issues in this neighbourhood and that activities at the facility exceed all other neighbourhood noise. We welcome an honest, unbiased study. All we're hoping for is the truth to be revealed, and some sort of resolution.

Meeting Day

The noise stopped at around 9:30pm on Friday... it had been going for at least two continuous hours. The noise has just this moment started up again. I'm hoping that it won't last for hours but who can tell.

I went to pay for my groceries yesterday and the transaction was declined, my account had been robbed. Given a short while to get over the initial shock of it, it really didn't bother me too much. What really blows me away is that my bank was notified that my account could be compromised and the issue was resolved fairly quickly. This noise issue, which is affecting the quality of life and well being of the people who live here, has been allowed to continue for over 2 years. I really feel that the noise bombardment from CB Freezers/Chill Chain Logistics is a far greater violation.

Today is the day we meet with the sound engineer. I wish I could be optimistic but our hopes for resolution have been dashed so many times before. I've become so accustomed to hearing "Sorry, nothing we can do about it" that I'm starting to expect it.

Thankfully that little round of noise has ended. Only a few minutes this time. Let's see how the rest of the day pans out.

I spent much of the afternoon in my basement... I could STILL hear the noise from across the street.

When we left the house just before 5pm the noise had been rumbling on for hours. We've just arrived back home and it continues.

Today I got an email from Dalton McGuinty's office. They replied to let me know that they've asked John Gerretsen, Minister of the Environment, or a member of his staff, to respond to my concerns directly.

My concerns? I've been told by the Ministry of the Environment that under section 9 of the EPA Chill Chain Logistics/CB Freezers does not require any approval from MOE. I do not understand why section 14 does not apply to them.

Here's what I'm talking about...

Prohibition, discharge of contaminant 14. (1) Subject to subsection (2) but despite any other provision of this Act or the regulations, a person shall not discharge a contaminant or cause or permit the discharge of a contaminant into the natural environment, if the discharge causes or may cause an adverse effect. 2005, c. 12, s. 1 (5).

“contaminant” means any solid, liquid, gas, odour, heat, sound, vibration, radiation or combination of any of them resulting directly or indirectly from human activities that causes or may cause an adverse effect;

1. (1) In this Act, “adverse effect” means one or more of, (a) impairment of the quality of the natural environment for any use that can be made of it,(b) injury or damage to property or to plant or animal life,(c) harm or material discomfort to any person,(d) an adverse effect on the health of any person,(e) impairment of the safety of any person,(f) rendering any property or plant or animal life unfit for human use,(g) loss of enjoyment of normal use of property, and (h) interference with the normal conduct of business;

CB Freezers, Chill Chain Logistics have caused just about every 'adverse effect' on that list so why are they STILL allowed to continue. I'm looking forward to hearing what Mr. Gerretsen's office has to say about it.

So, we really were lucky last night as the reefer in the front loading area was moved just after 11 pm.

This morning however reefers have been running continuously since at least 5:30 am. It's now 9:30. That's 4 hours of continuous noise from CB Freezers, noise coming from the Chill Chain Logistics refrigerated trailer units. When one turns off it only lessens the noise slightly because there are three of the things parked there and turned on.

As soon as I finish up some work I'm spending the day in the basement in the hopes of escaping this bombardment.

I listened to hours upon hours of banging today. Banging so loud it sounded like road construction when they break up the old paving. Now the drone of a Chill Chain Logistics reefer.

It used to be that at least there was some peace during the day. Not any more.

As expected the noise from CB Freezers/Chill Chain Logistics continued from Saturday afternoon and ran well into Monday.

Monday afternoon brought a city representative to my door. She was dropping off a notice to residents about the meeting with the sound engineer on Monday the 25th. I asked her what we were to do in the meantime. She replied "I'm just the messenger."

She asked if I was the one with the blog and if I could really hear the noise from inside my house. I answered 'yes' and got upset. I'm not really a crier but I find I can't control it anymore. The tears automatically begin to flow because I'm so tired and frustrated and no one seems to give a shit that we are suffering.

"This is really affecting you huh?" she asks. I assume she doesn't know that I've asked the Ministry of the Environment if someone needs to cause themselves bodily harm in order for someone to take action... I'm certain she doesn't know that a resident has offered to do it.

New neighbours should be talking about the weather, not about death as an option for dealing with noise contamination. The thing is that my neighbour is not alone. I've been in my home, listening to the droning noise coming from CB Freezers/Chill Chain Logistics and thought "If I were dead I wouldn't have to listen to this anymore." But here's the thing... I don't want to die, I love life, I love my family, I love making the most out of what I have... it's an uncontrollable thought that pops into my head because there is no other choice. They will not stop and no one will stop them.

CB Freezers/Chill Chain Logistics does not make medicine, they do not ship organs for transplant, they are not feeding starving masses, their businesses do not better the world. We are suffering because of frozen meat meant to be shipped to China and Russia. We are suffering so that they can make money at the expense of our health, sanity and quality of life.

CB Freezers/Chill Chain Logistics have been much noisier during the day than usual this past week. On Monday I was provided with hours upon hours of banging and rest of the week gave way to greatly increased reefer and truck traffic. This in addition to nighttime noise. At least we could look forward to the weekend and perhaps a little break from the noise... nope.

On Saturday at 3:30 in the afternoon a reefer was parked in the front docking bay, directly across from our house, and left running. Despite assurances that the reefers would be kept in the West lot, there are also four reefers in the East lot... two of those have been left on.

My husband has been awake since 3:30 a.m. because of this noise. This noise is directly caused by CB Freezers/Chill Chain Logistics. CB Freezers/Chill Chain Logistics has disrupted normal family activities in our home. The actions of CB Freezers/Chill Chain Logistics has disrupted our sleep, has been the direct cause of health issues, has been the direct cause of mood changes, has been the direct cause of stress of such levels that I was placed on sick leave from work, it is the direct cause of being medicated for these stress and sleep issues.

I need to be medicated so that I can live in my own home because of CB Freezers/Chill Chain Logistics.

We are not the only household in this neighbourhood requiring 'aids' in order to sleep in our own homes and keep our sanity intact. I personally know of two other households using aids in order to sleep because of the problems brought on by CB Freezers/Chill Chain Logistics.

We are not the only household whose health and quality of life are diminished as a direct cause of Chill Chain Logistics/CB Freezers. Representatives from any of the Willard family companies can tell me whatever they like but many people in this community feel that CB Freezers/Chill Chain Logistics are directly responsible for their health and quality of life issues.

And yet our 'good neighbours' continue to bombard us with noise. CB Freezers/Chill Chain Logistics and the Willard family companies, continue to disrupt our lives and our sleep and effect our health. Do they really care about this neighbourhood? I don't believe they do for a second.

A not so quiet Sunday dinner.

Yesterday evening a reefer was placed in the front loading area of CB Freezers. It was left there running. Initially it ran for a continuous hour disrupting our Sunday dinner, then intermittently throughout the night, waking us up.

I know that CB Freezers/Chill Chain Logisitics keeps doling out the 'we want to be good neighbours' thing but really... if I woke my neighbours up and was this disruptive to other peoples lives you can be certain that someone would put a stop to the un-neighbourly behaviour.

My husband spoke with Gary Dyke, Chief Administrative Officer of Quinte West, this morning and we have an update:

"... the City has engaged Coulter and Associates to conduct an engineering study with respect to the issues raised regarding CB Freezers.

A date has been arranged whereby John Coulter will meet with the concerned residents to receive their input directly. The meeting will be held on Monday January 25th at 6:00 pm in the Multi-purpose Room (downstairs to the left of the stairs) at City Hall. If you could forward this information to the rest of the neighbours who attended the earlier meeting with Councillor Alyea, it would be greatly appreciated."

We'll be there with bells on.

We've been told that the running reefers would be kept in the West lot... obviously this did not happen last night.

There was a knock at my door this afternoon. Two gentlemen from CB Freezers and Chill Chain Logistics offering a little holiday cheer in the form of a turkey. We spoke for a while and they told me that they do care about the area residents and I assured them that we appreciate the decrease in noise levels that we've experienced recently.

It's a difficult situation. They have a business to run... residents deserve a certain quality of life. What do you do?

Surely, no one truly understands the reach or impact of the noise issue here. I can't imagine that those gentlemen would knock on my door with a turkey if they really understood the damage caused by the noise not only to us, but to many other, less vocal, residents.

Anyway, I'm glad they came over and that we had a chat. We may not see eye to eye with them but they made a nice gesture and put forth a little effort, we've got to give them credit for that. In that same spirit I wish them a Happy Holiday, and sign off until the New Year.

Last week, our real estate agent and his broker met with Mayor John Williams and Gary Dyke, chief administrative officer. Our agent maintains that he was unaware of the noise issue and asked for a meeting with the City after we brought it to his attention.

My agent was told that until we moved into the area that there had only been two complaints made about CB Freezers. One of the two people named sold their home to an employee of CB Freezers. Interestingly enough, they failed to inform our agent that there had actually been a full presentation made to the City about the issue.

It was pointed out that in the City's investigation that the passing traffic was registering between 60-80 db. I asked my agent to consider the length of time it took a car to pass and if he could even hear the passing cars outside. No. Then why am I being woken up? He has been in my home and heard the noise for himself. Besides, no one is complaining about the traffic.

Our agent also asked about production from Midtown Meats being moved to CB Freezers. He was told that the company will be rebuilding a small portion of the Wellington site but that most of the production will be moved to the CB Freezers location.

He believed that the only way for resolution would be to approach the City with a proposal for erecting a sound barrier. The costs would be divided between the City, CB Freezers and the residents. I can't speak for my neighbours but I certainly don't feel that I should be paying to resolve the issues caused directly by a company that is making money at the expense of my health.

Speaking of health... I find it really difficult to understand the reluctance on the part of City officials to respond to concerns raised about CB Freezers. Besides the 'investigation' sent on November 30th, the last time I had a reply from the mayor from any of my complaints on this issue was in October. I've never had a reply from Gary Dyke. Now a member of council has asked an affected resident to cease all communication with him. People have serious concerns about their health! Christ, I now need medication as a direct result of this issue! What is going on here?!?

Then, rather suddenly, some good news...

Through the grapevine we're told that the mayor has said the city will hire an engineering firm to analyze the noise issue. We're very glad to hear that the issue will finally be examined but we hope that it's the 'normal' activity that is taken into consideration. When the city did their own 'investigation' it was awfully quiet around here and it's not the quiet nights we need to fix.

It wasn't until after 4:20 am that the noise on Thursday morning stopped. When it ceased we had been forced to deal with just over 10 1/2 hours of noise. Thank the gods Friday was a quiet night. Tonight the noise, for us at least, is minimal. I don't know how those in the west are doing.

Unwanted noise may seem like a rather small issue to those who are not forced to deal with it, but it can have many detrimental effects. Sound can damage physiological and psychological health, cause aggression, hypertension, high stress levels, tinnitus, hearing loss, sleep disturbances, and have other harmful effects. I never could have imagined the impact noise has had on my own life in the past four months.

Someone asked if I complain this much whenever things don't turn out exactly how I like.

What possible difference would that make? And what would it matter if I were the only one complaining? And what does it matter how long I have lived here? The simple truth is that is an issue, it remains unresolved and Quinte West officials and CB Freezers have completely failed to deal with this in an appropriate or professional manner.

I will not sit back while I am wronged, I will not tolerate being bullied and I will not let this go as long as it remains an issue. I may be tired, I may be miserable, but I AM motivated and we will see change.

Tonight we've been subjected to a constant, non-stop, continual noise coming from CB Freezers/Chill Chain Logistics for over 5 and a half hours. The sound/vibration is still rumbling through our walls and into our home.

We called the city... the offices were closed.

We called the police. We told the dispatch that we understood that there was nothing they could do but that at the very least we wanted our complaint on record. They sent two officers to speak with us anyway.

I've emailed the mayor of Quinte West John Williams, our Ministry of the Environment rep, Lou Rinaldi our MPP, and Scott Willard owner of CB Freezers, several times this evening.

We called CB Freezers directly and spoke with an employee who said he wasn’t sure why the reefer was left in the front because he was aware that it should have been in the west compound. He also said that the reefer could not be moved there are no drivers on site and that it could not be turned off because there was product in it.

We called Scott Willard. The number we had was disconnected but we looked up Willard Consulting and left a message. I'm sure he'll get it in the morning.

It's now approximately 11:45 and it's been 6 hours since the noise started.

Something Stinks....

... it's a rendering truck.

Tonight we saw (and smelled) a rendering truck, again, at CB Freezers. Wonder what exactly it's doing there since, according to the union site, the Willard's claimed in late August that "any rumours of meat production at their Trenton Freezer Storage facility are false. " I think someone is fibbing.

I was looking at the website for Midtown Meats, the processing plant that burnt down in nearby Wellington that is slated to move production to CB Freezers (also owned by the Willard family), and it gave me a giggle.

"As product specialists, our efforts are constantly focused on the key values that fuel our growth and build our market leadership: Excellence in Product Quality; Industry Leading Plant Efficiencies; Professionalism, Integrity and Reliability in dealing with customers. "

Integrity? I wonder what the unionized workers from Midtown Meats would say about that. They've been out of work since April and are still wondering about severance packages and job future. Ask yourself why the Willard's are not performing the necessary upgrades to the Wellington property in order to rebuild and allow people to return to work? Why are the workers being strung along? How does this demonstrate integrity in any way?

Laughable. They may provide jobs but the Willard family of companies has done nothing but continually disrupt our lives and our sleep for the past four months. They've been doing that to the long term residents since they moved in over 2 years ago. What have they done to support this community and their neighbours here?

The Willard family of companies like to use the words 'integrity', 'professional', 'quality', and 'excellence' an awful lot. Based on our experience, I don't think they have a clue what those words really mean.

So this morning at 2:20 am a reefer was moved to the front and parked at bay #4, then another reefer was moved and parked at bay #3...

My husband was not too pleased.

When Quinte West did their 'independent investigation' of the noise at CB Freezers they said that the sound of the reefers running was no higher than the sound of the distant train. They said that at no time did the reefers read higher than 50 db.

Sunday Loading & A Meeting

We went out for a lovely meal tonight only to return home and be greeted by a reefer and a truck parked directly at the front loading bay. While the reefer ran my husband noted "The windows are actually vibrating."

Despite the fact that Sunday is the only day that the bylaws protect us from the thumping and banging of trailers being loaded, at least three trailers were loaded/unloaded and moved around in the hour after we got home. The one day we actually have a smidgen of protection and they take that too. Ug.

Anyway, yesterday a city councilor stopped by the house to chat about the noise issue in our neighbourhood. We invited him to join us today as we met with neighbours about the noise issue.

Several neighbours came over to talk about the current situation, fears of what is to come, and thoughts about what our next step might be. It's pretty clear that the current resolution, parking the reefers in the 'West compound', is not the answer. While we have been enjoying some relief from the constant drone of the reefers, not all of our neighbours have been so lucky. It's really pretty incredible just how far the sound from CB Freezers/Chill Chain Logistics travels and we're beginning to wonder just how far that rumble reaches.

So, what is the next step? It's been made pretty clear that complaints from a couple of residents does not encourage change so we're going to try a petition. I'm not sure what good it will do but I think it's a fair step to take and I'm willing to give it a shot if that is what the neighbours want to try. If that doesn't work we'll continue to move on until we find something that does.

An Update

We've been away for a few days enjoying some holiday shopping and time with family.

This week has been fairly quiet for us except for the loading/docking at 4am which bothers my husband to no end. He's quickly reaching the end of his rope.

A letter from the City arrived this week saying that they had performed an 'independent investigation', spoke with CB Freezers, and “it is the City’s position that the activities taking place at CB Freezers are within normal practices for a legally operating industrial facility and no further action will be taken regarding this matter by the City.”

The nights that were documented were November 18th-20th... AFTER we noticed a marked decrease in the noise emissions.

The investigation they conducted was performed by, I believe, a city parking enforcement officer and not an impartial, professional, sound/vibration consultant.

The notes include 'Lights on all night at xx'. What does it matter if a light is left on in a house? Heck, what does it matter if someone chooses to be up all night dancing naked to Achey Breaky Heart so long as they are not bothering anyone else? This is highly inappropriate.

The findings included three readings of “0 db” when the reefer units were not running. This is next to impossible. 0 db is the very threshold of hearing. A silent bedroom will measure around 30-35db.

The investigators notes, as well as the mayors letter, states that the passing traffic ranged from 65db to 85db. The few seconds of a passing vehicle close to a sound meter is far different than the 45+ minutes of unrelenting noise I was subjected to at 4am last Friday morning.

Pah, no worries... I will continue to complain and fight and be a general pain in the bottom until this issue is truly resolved. I take total comfort in the fact that I know that I am not fighting this alone :)

It seems that Quinte West does have a bylaw in place for the loading and unloading of vehicles. See page 6, #11. The issue here is the designation 'other areas' which includes areas well populated by private residences. Perhaps, rather than allowing free reign (except for Sundays and holidays), the city could extend the time allowance from 9pm - 7am to 11pm - 7am in these areas as Guelph (see page 5) has done.

Almost a week...

We've managed almost a full week of relative quiet on the East side of the plant. The reefers have been moved to the West lot and, for me at least, it has made a world of difference. I'm not sure how those in the west are faring. CB Freezers/Chill Chain Logistics is still making quite the racket when loading/unloading trucks between 2 and 4 in the morning, but overall things have improved for us.

So, what now?

Some commenter's seem to think that earplugs are the answer but my neighbours (as well as my husband and myself) feel that dealing with the bylaw exemption is a more appropriate action. Asking the residents here to wear earplugs is like asking people to wear a gas masks so that industry can continue to pollute. It's not a solution.

Most city noise by-laws prohibit excessive noise between anywhere from 6-11 pm of one day to 7-9 am of the next day. Dealing specifically with the loading and unloading of vehicles. the city of Ottawa noise by-law prohibits "deliveries from a motor vehicle between 11 p.m. and 7 a.m. causing disruptive noise. " We'd like to see Quinte West to adopt a similar noise by-law.

The people here are not unreasonable. No one is asking for CB Freezers/Chill Chain Logistics to be shut down, we simply want them to respect their neighbours.

I've heard through the grapevine that the city was to meet with the Willard's, owners of CB Freezers/Chill Chain Logistics, about our noise issue. I'm glad to know that the ball is slowly rolling and that at the very least the issue is not being completely ignored by the city any longer.

Things have been a bit better over the past two evenings. Thursday morning at around 3 or 4 am there was a lot of noise and banging coming from across the street but at least the reefers had not been left on all night. When I got home yesterday after picking the kiddo up we could hear the rumbling as we came up from the waterfront path behind our house which continued, uninterrupted, for about two hours. There was a bit of noise last night too but it's been a great improvement over what we've been through the past two months. I hope things have improved for our neighbours as well and that this marks the beginning of change.

Noise and diesel

After midnight in the wee hours of Tuesday morning a truck pulled into the lot at CB Freezers/Chill Chain Logistics and left a reefer running into the morning hours. It's clear that some of the units are louder than others and this one was a doozy. My door was vibrating. The noise was incredible. I emailed the city again at 2:30 in the morning.

Yesterday I received an email from the Minister of Municipal Affairs and Housing. In his response he told me that he has spoken with the city, my MP, my MPP, ministry of the environment staff and has forwarded my concerns to the Minister of the Environment.

It really doesn't seem fair or right that such great steps need to be taken in order for this issue to be dealt with. The people here are not unreasonable. The effected people I have spoken with are not asking for CB Freezers/Chill Chain Logistics to be shut down, they just want a bit of peace and quiet through the night.

Something I haven't really touched on are the effects of the diesel emissions.

A chorus of noise

There are four trailers parked in the lot this morning. They've been running all weekend, cycling on and off, on and off. I'm not sure if some of the units are worse than the others or if there are moments when more than one is running at the same time. The noise can change from an annoying hum to an unbearable 'stuck in a snowbank' type of noise.

What is the point of leaving these refrigerated diesel trailers running all weekend long? With better planning couldn't this situation be circumvented? None of us can think of a good reason that the reefers should be parked and left running for days on end. This is not a one time annoyance, this is a continual problem that not only affects the people in this neighbourhood but is detrimental to the environment.

One thing that has stuck in my head through this ordeal is that when I have made complaints directly to CB Freezers they always divert the issue to 'the trucking company', A.K.A. Chill Chain Logistics. It was always said in a manner that would make one believe that they are completely separate entities. A little search this morning shows that not only are CB Freezers and Chill Chain Logistics run from the same address but contact information for both lead to Willard Consulting and Mr. Scott Willard.

Of specific interest on the Willard Consulting web site is this page.

The rollover for Canadian Blast Freezers lists "new plant acquisition" as the #1 point in their consultation case study. If they are talking about acquiring the plant located at 80 Carrying Place Road I'd say that they failed rather miserably in their acquisition considering the negative impact that their actions have had on the residents here. If they are talking about the acquisition of 'Midtown Meats' (a processing plant that recently suffered a fire in a near by town, the processing will be moved to CB in the near future) I'd say that this clearly demonstrates that not only do they not care about the current situation but that they have no issue with making the situation even worse.

I've heard many, many times that CB is concerned about their neighbours. The websites for CB Freezers, Chill Chain Logistics and Willard Consulting promote the fact that they are service driven, and quality conscious. As someone very personally affected by these companies I'd sooner eat my shoe than swallow a word of what they are dishing up.

It's one thing to wake up from a deep sleep, get annoyed, bury your head under a pillow and make an attempt at returning to sleep. It's another sort to be awoken by such a noise that you don't even bother to try to shut it out. I figured I might as well stumble down the stairs and start the day.

I came across an article yesterday that was published in the Simcoe Reformer. A couple was bothered by the noise coming from a local commercial property and went to the Ontario Municipal Board about it. The board said that the "county's handling of this matter has been half-hearted and ineffectual... there is no evidence the county is taking steps to ensure that noise ... isn't inconveniencing the neighbours." Sounds familiar.

It's been two weeks since CB Freezers put a letter in my mailbox saying that the reefers were going to be placed in the East lot, for one week, due to paving. Those things are still there, as they were long before, and where they will likely remain. I'm hoping and praying that those damned things aren't left running all weekend long again, but I won't hold my breath.

My husband commented tonight that this has probably been the quietest week we've had in a month and a half despite the fact that we are still being woken up most nights (including last night at around 12, 1 and 3 am). Starting at around 9 pm this evening the reefers parked at the front bay have been rumbling away on and off. This is where they are the worst for us. I can feel my front door vibrate from the noise.

I've asked another neighbour to write a few words about their experience living with CB Freezers/Chill Chain Logistics in their neighbourhood. Here's what he has to say...

I don't know how you do it! Living directly across from that monster called CB Freezers. I live to the west of CB, down at the water (which is quite a bit further away from them then you are) and I still find the noise emanating from the reefers exceedingly loud.....almost unbearable at night! The noise travels down my way and keeps me awake at night, affecting my and my family's quality of life in a major way....sleep deprivation! As you are fully aware, sleep deprivation is a horrible thing, making it nearly impossible to function properly through-out the day....especially when you have young children, like me. I'm also very concerned about the diesel exhaust fumes being released from the reefers night and day, and how it will affect my child's health in the future.

When I moved here a couple of years ago, I too investigated CB Freezers and was absolutely astonished to find out that they are exempt from the noise by-law. I was equally as astonished to find out that CB Freezers cared so little about the very real concerns of it's direct neighbours....brushing them off with the...."we can do what ever we want" attitude.

All of my surrounding neighbours are directly affected by CB in a negative manner ...some more than others, but there is one thing for sure. Everybody in the area is aware of CB's presence, especially in the middle of the night when they are at their absolute loudest. I find it difficult to understand why they have to leave their reefers running for days on end, when with a little better planning, they could load/unload the truck and drive it away to it's destination....immediately. Why do they have to leave it parked there running overnight, or over the weekend when they are fully aware that their neighbours as so affected by the noise? Something has to be done with CB Freezers....because they make terrible neighbours......and they don't seem to care about that fact.

Some people feel that I should not be complaining because I chose to move here. Some people seem to think that I am alone in my attempts to affect change. I've asked a long time resident to share her personal experience.

For 26 years I have lived next to CB Freezers formerly the FBI Juice plant. Never has there been a problem until CB Freezers came to town. Since 2007 I have been at odds with the City of Quinte West regarding the noise we have had to deal with.

I remember distinctly that it was the long weekend in May and I was looking forward to working outside all weekend. After about an hour of listening to the drone of the trucks I gave up and decided that instead of listening to the birds sing and having a peaceful time with nature, I was slowly losing my mind.

This continued regardless of the number of times we contacted the city. I have met with the Mayor, The CEO , actually I am on my second CEO, the Fire Chief, he's retired as well now, and the owner of CB Freezers. Apparently business can run rampant in the fair city and there is nothing we can do about it. We as residents however cannot make the same type of noise.

The heat in the summer and the running of the reefers cannot possibly be good for our health. But suck it up things don't seem to be changing. WE have contacted every area of government and the pat answer is a referral to someone else. There has been an audio/visual presentation made to council and still we don't seem to be able to get anything done.

My neighbour of 20 years finally sold their home and moved on. They were under no obligation so someone moves in and discovers the noise problem. Another neighbour further down the road in front of the plant sold their home after spending a couple of years redoing the entire house only to move on because they couldn't enjoy the yard and gardens because of the noise.

Lack of sleep is getting to all of us. White noise should not be allowed. Isn't that how they drove people crazy in Waco Texas? It's working.

Quinte West Love

I've said it before but apparently it's time to say it again: I love Quinte. I was totally excited about moving here because it's one of my most favourite places on earth. I love showing off the natural beauty of this place to visitors, and experiencing all that Quinte has to offer with my family. It's a great place filled with some of the best people I've had the good fortune to meet anywhere. Quinte West is a lovely place to be...

My problem is with Quinte West noise bylaw exemption #11, the resulting excess noise and the failure of city officials to protect Quinte West residents.

This is an issue residents have been battling for over 2 years. This is not something I imagined, invented or initiated. I have seen the complaints made by my neighbours dating as far back as June 2007.

Some people think that I'm just a petty city girl making a mountain out of a molehill, some that I'm trying to stand in the way of industry and jobs because of a little noise, and others see me as someone who is bitter about a bum real estate deal. The reality is that I'm just trying to make positive changes in a community I love, somewhere I now call home.

P.S. Apparently CB does have a certificate of approval... for what exactly I do not know but I'm going to try to find out.

I got an email from the Consumer and Clinical Radiation Protection Bureau yesterday. The gentleman who replied to my query said...

"You say that you have contacted everyone possible so I assume that you have contacted the noise bylaw authority for your municipality but, for some reason, you report that the issue is not being resolved."

I have replied to let him know that our municipality has exempted industrial and commercial properties from noise bylaws.

I've sent the document to our mayor.

There are a great deal of health related issues that can be directly linked to excessive night time noise.

“40 to 55 dB Adverse health effects are observed among the exposed population. Many people have to adapt their lives to cope with the noise at night. Vulnerable groups are more severely affected.

Above 55 dB The situation is considered increasingly dangerous for public health. Adverse health effects occur frequently, a sizeable proportion of the population is highly annoyed and sleep-disturbed. There is evidence that the risk of cardiovascular disease increases.”

The noise on my front stoop has regularly been above 70 dB at 2 a.m.

I took a reading inside my home of 57-63 dB last week after 1:30 a.m.

Up at 6 am this morning after another restless night. I couldnt' take the noise any longer.

It's like having a contruction vehicle turning on and off, all night and day, for days on end. Why are those things left running day after day? I just don't get it.

There is some question as to if CB should have to obtain an Approval for Discharge. I have no idea why they would not considering this similar establishment did... Sterling Packers

Thursday night didn't seem too bad for noise however my neighbours across the road told me that they could hear it at 2:30 in the morning. The units are currently parked in the rear of the lot so it's not as bad as it was when they were parked at the very front of the building. We can still hear it inside our home. This only lessens the noise... it does not stop it.

Last night was another story. We've had guests staying the past couple of days and they definitely noticed the noise last night. It's awful that this is even something we need to consider when inviting people to our home. Thank god the reefers weren't in front of the building. It would have been a sleepless night for many.

I was hoping that today would mark the last day of noise for us for couple of days. The letter from CB on Monday had stated that the reefers and trailers would be relocated for the remainder of the week... it didn't mention them staying all weekend long again. It was foolish of me to even think that they would give us some peace this weekend.

Last night was terrible.

I stayed in the back bedroom and was still bothered to no end.

My husband, who has slept through an explosion and requires shouting and shoving to be woken up, was woken up continually last night and into the morning.

He said the kiddo woke up and crawled into bed with him (I stayed in the guest room) and that every single time the noise increased from CB Freezers/Chill Chain Logistics that our son would flail around and become very agitated.

I really don't care what excuse CB Freezers is gives for the noise they are making, they are disrupting the sleep of my child, in his own home, with the windows closed!

3:30am and I've already been woken up a few times this evening.

It's not as bad as it was last week when the noise was eminating from directly across from my driveway. They've placed the trucks at the rear of the lot this time around. It was still enough to wake me up. I can't imagine that it doesn't bother the people to the side, although they do have trees separating them.

My kiddo has seemingly gone unscathed through all of this. Tonight I fell asleep beside him after reading his bedtime story and I realized that every time that damned noise goes off he starts to squirm in his sleep. While he may not be outright woken up this is definately having an effect on him.

A thought did strike me when I was woken up this morning. Despite the totally ridiculous noise by-law exemption for commercial and industrial properties, there are Quinte businesses listed on the Environmental Registry. I wondered if any had applied for a Certificate of Approval for Air & Noise. Yes, there are several. CB Freezers/Chill Chain Logistics is not one of them.

A certificate of approval basically grants a business permission to put emissions into the environment. The Environmental Registry lets the public know what is going on in their community and gives them the opptortunity to make comments and provide feedback. You can check out their searchable database here.

Why do some Quinte businesses have to apply for a Certificate of Approval for noise emissions and not CB Freezers?

CB Freezers processes (or will process, I have no idea what goes on over there) meat at their Quinte location, a search of the registry yeilds the following results...

Another Quiet Night!

Woo hoo! I'm feeling like a million bucks because I've now had two full nights of sleep. But what's this...

7:20 am on a Sunday and there is a stream of contruction equipment heading into the lot of CB Freezers/Chill Chain Logistics.

It's now just after 9am and they've been going strong for quite a while.

Funny because our by-laws prohibit construction on Sundays.

I'm not about to become one of those people who call the police at every opportunity. I know the police have better things to do... plus I'm not sure they would do anything anyway. The bylaw officer has the day off so it will have to wait until tomorrow.

In other news...

Since my real estate agent was unaware of the totally ridiculous lack of by-law protection for the people of Quinte West, I've decided to inform all real estate agents and real estate organizations in Quinte West about the noise by-law. Anyone buying near a property zoned as commercial or industrial has the right to know that they are completely unprotected by Quinte West noise by-laws. No one should ever have to say "I didn't know."

This afternoon was noisy for hours on end. If I stand in a certain spot in my hallway, a particular spot in front of a closet, the noise is at it's most muffled... unfortunately I can't stand in my hallway to prepare dinner or read to my kiddo.

I emailed my real estate agent to ask him if he was aware of the ongoing noise issues in this neighbourbood and if he was aware that there are no noise by-laws applicable to industrial or commercial properties in Quinte West. He came to my house while CB Freezers/Chill Chain Logistics were being their noisy selves, I had another meltdown, and he swore that he had no knowledge of either account.

I should say that not everyone has ignored me in all of this. Lou Rinaldi's office, (our MPP) has been responding to my emails with more than a "sorry, can't help" and for that I am really grateful. The people at our local ministry of the environment offices have been pretty great too. At the very least they've made an attempt to not be dismissive.

We went to see the Trenton Hawks hockey game tonight and it was wonderful (even though they lost). It was like being in an episode of Corner Gas. We were surrounded by great characters, cheering for the local boys. It was just as life should be in a small community. It's what I've been missing during these past weeks of hell.

When we got home tonight there were no refers parked in front. I put my kid to bed and enjoyed listening to the ticking of the clock in his bedroom.

I'm praying this means it will be quiet tonight. If the silence lasts all weekend it will be heaven.

Why is it necessary for CB Freezers/Chill Chain Logistics to keep refers in the front of the building every night? For what reason are they recently prevented from placing those things at the rear of that side lot?

I'm also curious as to why they are relatively quiet during the day but run all evening and into the wee hours of the morning?

I'd also like to know if throwing boxes of frozen product inside the refers at 4am is considered a normal part of the processing or manufacturing of goods? That's what time they woke husband up this morning.

I managed to get a bit of sleep last night because I've now moved myself into the downstairs guest bedroom where the noise is slightly more tolerable. It was a rainy day but it was pretty outside and it was quiet...

Quiet until 7pm then the on and off started up again.

I'd like someone to explain to me why CB Freezers/Chill Chain Logistics makes more noise at night than they do during the working day.

I'm seriously considering reversing my sleep schedule because the daytime noise is far more reasonable.

I sent a second email to my Councillor, Jim Alyea on Tuesday. Still no reply. This doesn't surprise me one bit since my first email sent on the 15th hasn't been answered either.

The thing that really gets me is that I've tried to be reasonable...

"Please believe me when I say that I am in no way looking to shut down or even move CB Freezers. I simply want to be able to function normally in my own home.

I understand that industry is important to the vitality of the local economy, but to give industrial and commercial properties free reign is unimaginable. There has to be a way for us to exist together. The people of this community need protection and are anxious for change. Many of the people I speak with believe that change will never come. Some have already moved away.

I’m asking you to help us. Please let us know what we can do to change the current unbearable conditions we are being forced to live with daily."

It has really surprised me that the one question that is never answered is 'how we can make change happen?' I still haven't figured it out.

The noise has actually been worse over the past 2 days and I am finding it difficult. I think that they've had some sort of vent or something installed. I saw them working on something on the roof yesterday.

There is no where I can go in my home to escape the new noise. When it was just the refers I could go into the back room and the rumbling hum was less audible. Today I could hear the new and improved continuous noise from 7am to 8:30 am and 3pm to 7pm even from my basement. There is literally no where left for me to go.

CB Freezers is not even bothering to move the refers to the side or back any longer. They've kept them running directly out front for days. They are torturing me inside my home. They are well aware that placing the refers in the front is most disruptive for us. They are sending a clear message that they can do as they please and there is nothing we can do.

I thought I'd let you know the actual effects that this has had on me since just complaining about noise seems a bit unimportant.

I've had extremely poor sleep, especially over the past month. I am now averaging about 4 hours of interrupted sleep a night. I quite literally feel like I did when I was a new mum.

The lack of sleep has caused side effects like poor concentration, forgetfulness and irritability.

I've been doing my best to act like everything is a-ok for my son. We go outside and shoot hoops in the front drive while the noise is blaring from the other side of the road. The truth is that I just want to beg them to stop.

My emotional and mental well being have been put the test. I have cried more in the past two weeks than I have in years and years. I have broken down in front of my child which I have not done since he was 2 years old. I simply do not understand how they can be allowed to put us through this. At least Noriega and the Branch Davidians had the option of surrender from their sound torture.

I cannot sleep in my own home.

I cannot sit in my living room and watch tv.

Now, with the new noise, I cannot eat at my own dinner table.

A chatty day

A bit of a change today, the noise actually got worse this afternoon and was continuous from at least 4pm till just before 8pm. It's now just before 11 and we're back to the regular old cycle of on and off. Despite all this I'm cautiously optimistic today. I've had a few conversations that have provided a glimmer of hope. A glimmer is all I need to keep me going.

Many people that I approach about this issue suggest going to the mayor of Quinte West, John Williams. They say that he's a great guy and I get the impression they think he will listen. I'd like to share my email to the mayor today.

"I know that you’re probably tired of hearing from me but I’m tired also. This morning I was woken up (again) before 4am from the refers and banging at CB Freezers.

I have spoken with Mr. Willard and was promised a good night sleep. I got just that. One night. The refers have continued to be parked in the front of the building and I am continually woken up. I have called the Ministry of the Environment and the police. I’m continually told to contact the municipality. “Talk to the mayor. He’s a nice guy.” Every time I tell people that we are unprotected by local by-laws because CB is zoned an industrial property people are gob smacked. I’m pretty certain the gentleman at the Ministry thought I’d lost my mind when I said that they were exempt from any municipal noise by-laws.

Please know that I am not looking to shut down CB Freezers and I’m not asking for them to move. I simply want to be able to sleep in my own home, I want to be able to have my family visit and I want to enjoy the normal use of my property.

I spoke with a woman on Saturday who said that her neighbours actually built a bedroom in their basement to escape the noise. They eventually moved because they couldn’t stand it anymore.

I listened to someone tell me about a friend, a cancer patient, who had to move because she could not recuperate in her own home.

I’ve spoken with a tired single dad who says “I can hear those reefers at night like they're right outside my bedroom window and I live quite a bit further away from them then you do. I find the noise gets quite a bit louder when the foliage disappears. My neighbours …. can't stand them as well, and are really affected by the noise emanating from CB…”

My neighbours, even those unaffected by the noise, are totally disillusioned by their city and have no faith in their elected officials. Maybe because I’m new to all this I’m not that jaded just yet.

I’d like to ask two things of you.

1. Please come out and hear for yourself what we are subjected to at 1, 2, 3 and all hours of the morning. Walk around this neighbourhood and talk to the people who are affected.
2. Let us know what we can do to affect change. We are willing to work for the betterment of our neighbourhood and to improve the lives of our neighbours, just tell us what we can do."

His response was that he would speak with Mr. Willard about moving the refers to the north and west where they should cause less noise to the residents.

My reply:

"That’s good for us but worse for our neighbours to the west.

You really should come out right now and hear what we’re dealing with. Something has been running non stop all afternoon and I suspect will do so all night long."

His final response was that CB Freezers have the authority to operate their business and would look into it.

Sigh Another sleepless night.

Woken up before 4am by the refers. Three are parked at the front bay. Call the OPP once again. This time I'm told there is nothing they can do. They say that I should talk to the by-law officer, or the mayor. Have done, no options there. I ask for an officer to come out to listen to the noise, so that they can see how bad this is.

Two officers come out and say there is nothing they can do. I mention that according to the Environmental Protection Act they have the ability to enforce violations to the act. They say that they would need to be guided by the Ministry as to what they could do. They also say that this is the first complaint that they've had about this. Hmm, I called just a couple of days ago. I'm also fairly certain that my neighbour has called before. Will speak with her to make certain.

I also called the Ministry of the Environment Pollution Hotline 1-866-663-8477 The guy I speak with says that I called the other night... I say the situation is worse this evening and that I have been woken up and cannot sleep in my own bedroom. What I find interesting is that I had called a different number the previous night, the Spills Action Centre 1-800-268-6060

Really, honestly and truly I just want to be able to sleep in my own home.

Stories from the neighbours

Once again there were a lot of people who were not home on our rounds today. No worries because I'm planning on heading out again on Monday.

I did speak with a lady just down the road who told me about the neighbours that she used to have, people she really liked, that moved because they were being driven mad by the noise. She told me of people building bedrooms in their basements to get away from the rumbling hum.

I've been told about sick people, cancer patients, having to move because they couldn't stand being in their own homes to recuperate.

I heard from another neighbour that every time the refers are moved to the 'west lot' when we complain, the noise gets worse for them.

Even the people who say that they are not affected by the noise are sympathetic and fairly flabbergasted when they are told that Quinte West has no noise by-laws for industrial or commercial properties in the manufacturing or processing of goods or products.

I'm new at this so I still have hope for change... but I can't blame the people who have lived with this for far longer for giving up.

It's a fair bit quieter this evening but there is an odd humming which I can hear in the house. Now that I've gotten to know some of them, I really wonder and worry if my neighbours can hear it too.

My neighbourhood

We only canvased half of our neighbourhood yesterday. Since it was a Friday most people were not home. A couple of people I did meet were elderly neighbours who were totally awesome to chat with. Although they said they were not affected by the noise (which I am glad of) we had a few really great conversations. One thing is perfectly clear, no one here has faith in their elected officials. No one feels change will happen.

I thought that I'd address just two things that have come up...

#1. It is not my aim to shut down CB Freezers.
I do not want people out of jobs and it is in no way my intention to shut down a business that has every right to operate. My goal is simply to have them operate in a manner that does not violate the Ontario Environmental Protection Act or my own rights.

#2. I am in no way complaining about the air traffic noise.
Trenton, Ontario is a proud military town. We were well aware of the airbase located within Trenton. I have seen the crowds that gather to greet the loved ones of our fallen heroes. When we occasionally hear an aircraft pass it is a reminder of those that are fighting for us. Aircraft noise is not an issue.

A single night

After having a complete breakdown and basically begging for sleep, the quiet in our neighbourhood lasted exactly one night.

It started up again last night. Despite being assured that they would make every effort to keep the refer units in another lot there were three in the front bay directly across from my home.

I did take another reading on the meter but it was pretty windy and that was effecting the readout. So although it's high, it's also all over the place ranging from 60 - 90 dBC, so not accurate at all.

I called the OPP last night and explained that I was aware of the exemption to the noise by-law for industrial properties in Quinte West but I wanted to know how loud something needed to be before I contacted them. I was told that if it was loud enough to bother me that I could file a complaint. Did I want to file a complaint? Yes.

Within 45 minutes the refers were being moved from the front of the building. I'm not entirely certain where they were moved to but I could still hear them though they were slightly less loud.

Today I brave the dreary, rainy weather and canvas the neighbourhood.

A Complete Breakdown

Scott Willard of Canadian Blast Freezers contacted me yesterday morning and I had a total meltdown. We had two conversations yesterday. Let's review some of it ...

He suggested that I believed they were making more noise in retaliation for complaining and that the increase in noise was imagined because I was annoyed. He was incredulous when I said that refers had been parked in the front of the building, and that they had been cycling on and off all weekend long.

To his credit, when Mr Willard actually looked into the issue, he called back to apologise. He was not aware that the current construction at the site had caused some of the refers to be moved.

He said that the 'banging' I heard did not come from them. That perhaps someone was banging on my door.

I said that I stood in the middle of my driveway and heard it coming directly from them and that I had video of the event.

He asked why I would chose to live on a highway.

I told him it wasn't exactly the QEW.

He asked why I would chose to live across the street, when I knew there was an industrial property there.

I said I wasn't aware the the noise by-laws would be non-existent for industrial properties in Quinte and asked him if he would think of looking up by-laws before moving into a new area. Later I explained that we had moved from a noisy location, that we were used to noise, but that this is far worse. The 'you moved here' argument is all sorts of bunk. What about the neighbours who have lived here for 20+ years?

He noted that in the video you could clearly hear a car passing and that the meter went up at that point.

Yes. When the car passes the level goes up to about 67-69. This reading was taken about 4 meters from the road. This is the daytime/rush hour background noise of my neighbourhood. I noted that at 2 am, more than 20 meters back from the road, at my front door, the reading is consistently in the 70's due to the noise from their facility. (This is about the same level as a vacuum)

**Video Voluntarily Removed: Someone felt that my son being in this video was in some way wrong. My son was simply excited about using the new sound meter and fascinated with video. He is effected by the noise but I will not be accused of using him as a pawn in this issue.**

He said that the situation would be getting worse with the increased production.

He said that there would be video cameras installed on the premises.

He said that with the increased production there would be no issues with rodents.

This is something that my neighbours were very concerned about with the expansion.

He asked if we would be planting trees on our own property.

This was in response to my questioning the possibility that they plant a berm of trees, a suggestion posed by Lou Rinaldi's (my MP) office "approach CB Freezes [sic] about working cooperatively on the problem - possibly a berm or trees to contain the noise." I said we were planning on planting next year.

He asked what I wanted.

Sleep.

When Mr. Willard called the second time, and I had sort of calmed down, he swore to me that I would get a peaceful night sleep. I have to say that yesterday was very quiet and if I wasn't running on minimal disrupted sleep over four days I might have even enjoyed it.

The big question in my mind today is: Why should I be grateful for one night of sleep in my own home?

Canadian Blast Freezers didn't get back to me via email or telephone... or heck, even walk across the street for a chat. Neigther did the 7 councillors I wrote to. My MP and MPP have been little help either. That's fine because it seems everyone except the residents has been passing the blame and doing squat for this community.

And so today I bought a sound meter. I know it's not exactly the most precise scientific instrument but I don't have $100's to spend. The $50 version will have to do.

I also sent a letter to about a zillion people including the Prime Minister. I know it's far fetched but it makes me feel like I'm trying.

A new week

I'm trying very hard not to fixate because I'm know I'm starting to drive other people crazy with my sleep deprived rants but it's hard when the noise continues all day long and into the wee hours of the morning.

I hope that this can be resolved soon... I just want a normal home, a quiet bedroom and to know that I can sit in my living room and unwind after the kiddo has gone to bed without that damned rumble tormenting me.

I finally went to bed at 4am this morning and the noise was still cycling on and off. At 6am it woke me up. It's now almost 10:30 am on Sunday morning and I can still hear them.

A meat processing plant in a nearby town burnt down recently and I heard that CB Freezers will be taking over their processing. In my last two emails to Canadian Blast Freezers I asked them to confirm these rumours and dispel the fears that my neighbours and myself are feeling. The only reply that I've had is the marked increase in the frequency and level of noise.

I am terrified that this is going to get worse. Just how bad does this situation need to get before changes are made?

I don't think that it's too much to ask for Quinte to protect it's people by placing some guidelines on commercial and industrial noise emissions in primarily residential areas.

The on and off started around 7ish and has continued all night.

I'm tired. I'm grumpy. I'm completely stressed. I can't savour the silence between the rumblings because I'm so anxious about it starting up again.

I'm not keeping track tonight. I'm going to veg in the back room of the house where the noise is less audible and try to distract myself.

I was speaking with my husband about just how badly this is beginning to effect me and he actually suggested putting the house up for sale. We only moved in 2 months and 7 days ago.

Anyway, I'm not moving just yet. I'll very likely lose my mind, start walking imaginary dogs and saving toe nail clippings, but I won't give in, or give up that quickly.
